General Trading Terms and Conditions
These Terms & Conditions may be subject to change without notice. Ride Mechanic (ABN 85 164 121 073) herein referred to as “Ride Mechanic”. “Customer” means the person, partnership, corporation or other legal entity, which places an order with Ride Mechanic for the supply of products listed on website. If you do not fully understand these terms & conditions please seek independent legal advice.
1.Acceptance of Quotation or Offer: Any quotation or offer made by Ride Mechanic and accepted by the buyer does not constitute a binding contract and Ride Mechanic reserves the right to accept or reject in its absolute discretion any orders which may be received by it. Contracts become binding only when confirmed by an invoice or in writing confirming the agreement between the Customer and Ride Mechanic. The quotation, order, invoice and written acceptance supplied by Ride Mechanic shall constitute the whole agreement and all representations, warranties, conditions, and liabilities (statutory or otherwise) not contained therein are expressly excluded. Prices, quantities and deliveries quoted are contingent on the buyer at the time of ordering. Any conditions attached to an order or contained in any written order received by Ride Mechanic are subject to all Ride Mechanic Trading Terms and Conditions.
2.General: The products sold by Ride Mechanic are sold on these Trading Terms and Conditions and form part of the sales contract (express or implied) between Ride Mechanic and the Customer. The only contractual terms which are binding upon Ride Mechanic are those set forth herein or otherwise agreed to in writing by Ride Mechanic and those, if any, which are imposed by law and cannot be excluded. These Terms and Conditions and any contract including them shall be governed by the laws of Queensland and Ride Mechanic and the Customer submit to the jurisdiction of the Courts of that State. The Customer further acknowledges that Ride Mechanic Trading Terms and Conditions may be amended at any time without notice to the Customer.
3.Price List: Prices listed on website may be subject to change without notice if there are relevant cost increases.
4.Delivery: The Customer pays transport costs as listed and accepted upon placement and payment of order.
5.Acceptance: The Customer shall inspect the goods forthwith upon delivery and shall within seven (7) days from the date of delivery give written notice to Ride Mechanic if the Customer alleges that the goods are not in accordance with the contract. Acceptance of goods shall be deemed to form part of a contract of sale between Ride Mechanic and Customer in accordance with these Terms and Conditions. If the Customer shall fail to give such notice then to the extent permitted by statute the goods shall be deemed to have been accepted by the Customer and the Customer shall pay for the goods in accordance with the provisions hereof. All returns must be approved by Ride Mechanic.
6.Payment: Payment for goods sold by Ride Mechanic to the Customer shall be pre-paid via online Pay Pal transaction.
7.Risk: Goods supplied by Ride Mechanic to the Customer shall be at the Customer’s risk immediately on delivery to the Customer or into the Customer’s custody (whichever is the sooner).
8.Cancellation: Orders cannot be cancelled except with written consent granted by Ride Mechanic.
9.Warranties: The only conditions and warranties which are binding on Ride Mechanic in respect of the state, quality or condition of the goods supplied by it to the Customer. Except to the extent provided immediately above Ride Mechanic shall have no liability (including liability in negligence) to any person for any loss or damage consequential or otherwise howsoever suffered or incurred by any such person in relation to the goods and/or advice, recommendation(s) or information and without limiting the generality thereof in particular any loss or damage consequential or otherwise howsoever suffered or incurred by any such person caused by resulting directly or indirectly from any failure, defect or deficiency of whatsoever nature or kind of or in the goods.
10.Confidentiality and Privacy: Ride Mechanic agrees to take all necessary steps to ensure Customer details remain confidential and are not used for any purpose other than to complete the approved transaction.
11.Force Majeure: Ride Mechanic is not liable for failure to perform the Contract to the extent and for so long as its performance is prevented or delayed because of; circumstances outside Ride Mechanic control; failure of Ride Mechanic machinery; or failure of a supplier to Ride Mechanic.
